MetroFocus: October 22, 2015

Horse carriages are an iconic new York sight, but the practice is heavily debated. We discuss the issue from both sides with animal rights activist Jane Velez-Mitchell and horse carriage owners. Plus, former NYC Police and Corrections Commissioner Bernard Kerik speaks about his mission to reform our criminal justice system after his experiences on both sides of the prison bars.

TRADITION IN OUR CITY, ARE THE

HORSES IN OUR CENTRAL PARK

SUBJECTED TO HORRIFI

CONDITIONS, OR ARE ANIMAL RIGHTS

ACTIVISTS TO EXTREME

AND THE TOP COP, LANDED TH

JAILER IN JAIL, AND NOW OUT OF

PRISON, HE TAKES A LOOK AT

POLICING NEW YORK, WHY HE THINKS

THERE'S SO MUCH TENSION BETWEE

THE MAYOR AND THE POLICE

ALL THAT AND MORE ON "MET AR

-- NOW

>> THIS IS "METROFOCUS."

FUNDING FOR THIS PROGRAM, WA

PROVIDED BY:

>>> FOR MORE THAN 150 YEARS NE

YORK CITY'S HORSE CARRIAGES HAVE

TAKEN PEOPLE AROUND CENTRAL PARK

AND MAYOR De BLASIO HAS PUSHED

TO GET THEM OFF THE STREET

ACCORDING TO THEM, THE HORSE

ARE WELL CARED FOR AND THE

ARGUE THATTHE BAN WERE T

HAPPEN, IT WOULD BE A BLOW NOT

ONLY TO THE INDUSTRY, BUT TO A

WHOLE WAY OF LIFE.

>> WE HAVE 68 CARRIAGES THAT G

TO AND FROM THE PARK, IT'S 272

TRIPS.

SINCE 1981

WHICH IS 35 YEARS.

34 YEARS, WE HAVE HAD THRE

HORSE DEATHS

THREE.

DUE TO CARS.

WE HAVE DONE OVER 25 MILLION

TRIPS.

IT'S NOT, IT'S NOT HAZARDOUS, IT

NOT DANGEROUS.

ANY ENFORCEMENT AGENCY, WHICH IS

NOW THE NYPD MOUNTED UNIT IS

ABLE TO COME THROUGH THE STABLE.

JUST ON A QUESTION, IF THEY HAVE

A COMPLAINT, THEY DON'T HAVE T

GET A WARRANTOR ANYTHING LIK

THAT

THEY WALK STRAIGHT IN HERE, AN

THIS IS OPEN FOR INSPECTIO

24/7

>> I WOULD LIKE TO SAY TO TH

MAYOR, ANY TIME HE WANTS TO COME

TO THE STABLES, I GIVE HIM A

TOUR, AND I WILL SHOW HIM WHAT

WE DO WITH THE HORSES.

I DON'T THINK THAT WHAT I COUL

WITH MY HORSE IS WRONG

I ALWAYS TAKE CARE OF MY HORSES.

EVERY DAY, I GOT TO COME EARLY

TO THE STABLES AND I HAVE TO

COME IN AND CHECK THE HORSES AND

MAKE SURE THEY ARE OKAY.

VY TO CLEAN THE HARNESS AND TH

HORSES AND THEN I BRING THEM

DOWN AND GO TO THE PARK.

IT'S A LOT OF WORK EVERY DAY

IT NOT EASY.

>> I CONSTANTLY HAVE A BOND WITH

TYSON, I'M ALWAYS BRUSHING HIM

AND COMBING HIS MAIN, AND I'

ALWAYS AROUND HIM.

SO HE HAS MY SMELL SINCE DAY

ONE.

WHAT SEPARATES US, THE CARS AN

THE HORSES, IS THE GREATESTEST

ANIMAL ON THE PLANET AND THAT'

THE HORSE.

>> I THINK THEY ARE ICONIC AND

WONDERFUL, AND PART OF CENTRAL

PARK

>> IT'S NICE TO HAVE THEM, WHERE

IT'S JUST HARD TO HAVE MOTOR

VEHICLES, IT'S NICE TO SEE

HORSEPOWER

>> IT GIVES A GOOD VIBE IN THE

CONTRAST TO THE YELLOW CABS.

NICE THING FOR US AS TOURISTS.

>> SO NOW HEARD FROM THOSE THA

THINK THAT THE CARRIAGES ARE A

PART OF NEW YORK'S CULTURE, BU

IF THAT CULTURE IS CRUEL AND

USUAL, WE WILL HEAR FROM JAN

MITCHELL, SHE IS THE CONTENT

EDITOR FOR JANE UNCHAINED.COM.

>> THANKS FOR COMING

>> YES

>> ANIMALS CANNOT SPEAK FO

THEMSELVES, SO I'M HERE TO SPEAK

FOR THEM

HORSES ARE FLIGHT ANIMALS AN

PASTURE ANIMALS.

THEY GO FROM BEING A LOCKED IN A

STALL, TO BEING A CARRIAGE

HORSE, AND THEY ARE NOT GOING TO

A PASTURE, AND THEY ARE IN THE

MIDDLE OF ONE OF THE BUSIEST

CITIES IN THE WORLD.

THIS IS NOT THE 18TH CENTURY

WE HAVE FIRE ENGINES AND AS FO

BEING SAFE, PLEASE

ANIMAL LEGAL DEFENSE FUND HAD TO

GO TO COURT TO GET THE RECORDS

FROM THE NEW YORK CITY THE

POLICE DEPARTMENT.

AND I HAVE THEM IN MY HAND AND

AFTER FIGHTING, WHY DID THEY

WANT TO KEEP THEM SECRET

AFTER FIGHTING AND GETTING THE

THROUGH A NOYA, 25 PREVIOUSL

REPORTED ACCIDENTS, FEEL FREE TO

SEE THEM, INCLUDING INJURY TO

SMALL CHILD WHO HAD TO BE RUSHED

TO THE HOSPITAL.

THEY ARE DOWN PLAYING THE DANGER

OF THE HORSES IN THE MIDDLE OF A

BUSY STREET.

YOU CANNOT USE TRADITION T

JUSTIFY CRUELTY.

YOU WANT TO USE TRADITION,

CHASTITY BELTS WERE TRADITION.

AND WE WERE NOT WEARING THEM

ANYMORE.

AND ONE OTHER THING, YOU WANT TO

SAY, THAT YOU WILL ROB NEW YOR

CITY OF ROMANCE.

IF YOU HAVE TO USE ANIMA

CRUELTY TO HAVE ROMANCE, YOU

NEED TO GO TO A MARRIAGE

THERAPIST.

I HAD A ROMANTIC TIME IN LONDON,

AND THEY HAVE BANNED HORSES.

IT'S THE 21st CENTURY.

AND MAYOR BILL De BLASIO

CAMPAIGNED ON A TOPIC THAT H

SAID REPEATEDLY, WHERE HE DI

NOT SAY, I WOULD LIKE TO GET THE

HORSES RETIRED, IF IT'S EASY

>> HE THIS WON, HE SAID.

THEY WOULD BE BANNED ON DAY ONE.

>> HE SAID THEY WOULD BE BANNE

IN DAY ONE AND IT 600 DAYS IN TO

TENURE AND THEY ARE STILL ON THE

STREETS AND HE IS PLAYIN

POLITICS WITH THIS ISSUE

I VOTED FOR HIM, THE ONL

ROUTINE I DID NOT SUPPOR

CHRISTINE QUINN, ONE REASON,

THAT BILL De BLASIO, PROMISED TO

RETIRE THE CARR AMPT -- CARRIAGE

HORSE, AND THE OTHER THING I

THEY HAVE A HOME WAITING FOR

THEM

THEY WILL HAVE A PLACE WAITING

FOR THEM

THEY HAVE A PASTURE TO GRAZE I

AND PROBABLY FOR THE FIRST TIM

IN THEIR LIVES

A LOT OF TIMES THE HORSE ONE

DISAPPEAR, NOBODY KNOWS WHER

THEY HAVE WENT OR GONE TO.

THAT RAISES OTHER TROUBLIN

QUESTIONS.

WHEN YOU SEE ANIMAL CRUELTY,

FOLLOW THE MONEY

THIS IS NOT ABOUT TRADITION.

THIS IS ABOUT PEOPLE MAKIN

MONEY OFF OF THE BACKS O

ANIMALS.

>> THAT MAY BE THE CASE, BUT LET

ME STATE A FEW OF THE THINGS

THAT ARE IN PLACE NOW REGARDIN

THE WELFARE OF HORSES.

THE HORSES ARE OVER SEEN BY FIVE

GOVERNMENT AGENCIES.

144 PAGES OF REGULATIONS

AND THE HORSES CAN WORK NO MOR

THAN 9 HOURS A DAY

THESE ARE THE REGULATIONS, YOU

CAN RESPOND AFTER I'M DONE

THEY CANNOT WORK IN TEMPERATURES

BELOW 19 DEGREES OR OVER 8

DEGREES.

>> I LOVE ON CENTRAL PARK SOUT

AND I SEE THESE RULS VIOLATE

EVERY DAY.

>> YOU CAN RESPOND AFTER

>> SURE.

>> THEY MUST HAVE FIVE WEEKS OFF

IN A YEAR.

AND THEIR STABLES ARE OPEN T

UNANNOUNCED INSPECTIONS 24/7

>> THEY HAVE GOT FIVE WEEKS OF

A YEAR

WHERE DO THEY GO ON VACATION

WHERE DO THEY GO ON VACATION

>> THEY HAVE TO GO TO A SANCTION

STABLE

>> OH, YEAH, DID YOU FOLLOW THEM

OUT.

THEY SAY A LOT OF THINGS THA

ARE VIOLATED ALL THE TIME.

I LIVE NEAR CENTRAL PARK SOUTH

I SEE THEM IN BITTER COLD AN

HEAT, I HAVE SEEN A HORS

TETHERED AND TRYING TO GET T

WATER AND UNABLE TO GET TO THE

WATER.

THESE ANIMALS CANNOT SPEAK FOR

THEMSELVES

AND THIS IDEA THAT PEOPLE AR

PRESERVING A TRADITION

YOU KNOW, TRADITION HAS BEEN

USED TO JUSTIFY CRUELTY AS HAV

THE ISSUE OF JOBS.

WHETHER IT'S SLAVERY

WHETHER IT'S WOMEN'S RIGHTS.

WHETHER IT'S CIVIL RIGHTS.

THEY SAY, THIS WILL ELIMINAT

JOBS

NOW THE PEOPLE THAT WANT T

RETIRE THE HORSES HAVE GONE TO

TREMENDOUS LENGTHS, TO COME UP

WITH ALTERNATIVES.

AT THE BEHEST OF MAYOR BILL De

BLASIO

>> THEY DON'T WANT TO HAVE THAT.

THEY WANT THE RIDE THE HORSES.

>> THEY ARE MAKING THE MONEY OFF

THE BACKS OF THE HORSES.

>> THE DRIVERS ARE NOT MAKIN

THAT MUCH.

SOME OF THEM ARE DOING BECAUSE

THEY WANT TO

>> THE MAYOR BACKED OFF BAUGH OF

THE POWERFUL TEAMSTERS UNION

WHEN HE MADE THE PROMISE I

FRONT OF THE WORLD, HE KNEW IT

WAS A CONTROVERSIAL ISSUE.

HE KNEW THAT THE TEAMSTERS WER

BACKING THE HORSE DRIVERS.

HE MADE THE PROMISE, NOW HE IS

ELECT HADDED AND HE SAID, OH

THE CITY COUNCIL, NOT ENOUGH

SUPPORT.

HE PUT THE BILL IN TO THE CITY

COUNCIL AND HE HAS NOT LOBBIED

FOR IT

HE IS PLAYING THE WORST SORT O

POLITICS

AND LET ME TELL YOU, IF YO

CANNOT TRUST HIM ON THIS

PROMISE, WHAT PROMISE CAN YO

TRUST HIM ON

>> IF HE IS GOING TO MAKE

PROMISE AND THROW THE HORSES

THE NEW YORKERS WHO LOVE HORSE

AND THE CITY COUNCIL UNDER THE

BUS, CAN YOU BELIEVE HIM O

ANYTHING

>> JANE, HE IS ACCURATE WHEN H

SAID IS HE DOES NOT HAVE THE

VOTES IN THE CITY COUNCIL.

>> HE DID NOT LOBBY FOR IT

YOU CANNOT PUT A BILL IN AND NOT

LOBBY FOR IT AND THEN SA

THERE'S NO SUPPORT

HE IS PLAYING POLITICS

WE ELECTED HIM BECAUSE W

THOUGHT HE WAS THE

ANTI-POLITICIAN.

BUT THIS IS THE WORST SORT O

MANIPULATIVE POLITICS.

I WOULD RATHER HAVE SOMEONE THAT

IS HONEST AND SAYS THEY DON'

CARE

INTRODUCING A BILL AND LETTING

IT DIE

LET ME SAY THIS, THERE'S A

CHANCE FOR REDEMPTION, THERE'S A

CHANCE FOR COMPROMISE.

IF THAT BILL DOESN'T WORK, W

COULD CREATE SOMETHING THA

WOULD GRADUALLY RETIRE THE

HORSES AND ENSURE THAT EVERY

DRIVER GETS A BETTER SAFER JOB

THAN THEY HAVE RIGHT NOW

>> THE REASON THAT THE MAR -

MAYOR GAVE WAS THAT THE HORS

RIDES ARE TOO POPULAR.

GET RID OF THE CARRIAGE RIDERS

>> THERE'S MANY THAT HAVE THROWN

THE CARRIAGES AND RUNNING TH

WRONG WAY DOWN THE TENTH AND

NINTH AVENUE

CRASHED IN TO SUVs

GOOGLE IT.

DON'T BELIEVE ME

AND YOU WILL SEE THE VIDEO AND

THE PICTURES FOR YOURSELF.

>> YOU ARE A VETERAN JOURNALIST,

YOU HAVE BEEN ALL OVER NEW YOR

CITY

>> BORN AND RAISED

>> YOU KNOW, IF THE MARRIAGE O

NEW YORKERS --

>> THE MEDIA

MEDIA.

>> LET ME ASK THE QUESTION T

CITY COUNCIL IS VOTING THE WAY

THEY ARE VOTING IS BECAUSE THE

THINK THEIR CONSISTENTS WANT T

VOTE THAT WAY.

>> WHY DO YOU THINK PEOPLE VOTED

FOR HIM?

>> 75% OF THE VOTERS, IT WAS A

HOT OF REASONS

>> BUT THESE STATISTICS HAVE

BEEN MANIPULATED BECAUSE THERE

ARE TREMENDOUSLY POWERFUL FORCES

THAT ARE BEHIND THE CARRIAGE

HORSE INDUSTRY

IT'S CALLED THE TEAMSTERS.

I BELIEVE IN UNIONS, BUT THE

HORSES HAVE NO UNION

THEY HAVE NO ONE TO SPEAK TORE

THEM

YOU KNOW, AMERICA IS THE CAPITAL

OF THE WORLD, WHAT HAPPENS HER

RADIATES ALL ACROSS THE GLOBE.

AND IF WE ARE GOING TO BE THIS

HEARTLESS AND PRIMITIVE, TO LE

FLIGHT ANIMALS, WHOSE HOOVES ARE

NOT MEANT FOR CONCRETE, TO FIGHT

IT OUT EVERY DAY WITH SCREAMIN

MOTORCYCLES AND CARS, ZIPPIN

BY, TERRIFIED THESE ANIMALS,

NEVER A DAY TO ROAM IN A

PASTURE, SHAME ON US

>> SO WHAT ARE YOU AND YOU

FELLOW ADVOCATES GOING TO DO

THAT HAVE NOT BEEN DONE TO

CONVINCE THE REMAINING NEW

YORKERS AND THE CITY COUNCIL T

PASS THE BAN

>> THE MAYOR PUT THIS ON HIS

SHOULDERS.

HE MADE THIS A SIGNATURE OF HI

CAMPAIGN

MAYOR BIG De BLASIO, LIVE UP T

YOUR PROMISE

DO WHAT YOU SAID YOU WERE GOIN

TO DO.

TALK TO THE CITY COUNCIL

PUT YOUR WEIGHT BEHIND IT.

BECAUSE WITHOUT YOUR WEIGHT,

THERE'S NO INCENTIVE FOR THE

CITY COUNCIL, THE COUNCI

MEMBERS THAT DID NOT MAKE IT A

SIGNATURE OF THEIR CAMPAIGNS T

DO WHAT YOU SHOULD BE DOING.

MAN UP AND HAVE ARE THE MORA

COURAGE TO STAND UP TO THE

FORCES MOTIVATED BY GREED AND DO

WHAT YOUR HEART TELLS YOU TO DO.

YOU CAN COME UP WITH A

COMPROMISE, PHASE IT IN OVER

FIVE OR SEVEN YEARS, BUT DO TH

RIGHT THING, SIR

THAT'S WHY I VOTED FOR YOU

>> OKAY, JANE, THANK YOU VER

MUCH

NEXT TIME, DON'T HOLD BACK

PLEASE

>> YOU KNOW WHEN YOU HAVE TO

SPEAK FOR THE VOICELESS, YOU

HAVE TO BE SPEAKING UP LOUD.

>> THANK YOU SO MUCH, REALLY

LET ME THROW THE QUESTION TO

YOU, SHOULD THE HORSE BE BANNE

FROM THE PARK, OR SHOULD THE

REMAIN AS A STAPLE OF LIFE,

WANT TO HEAR FROM YOU.

>>> FORMER NEW YORK CITY POLIC

OFFICER BERNARD CARRICK, HE HA

BEEN CREDITED WITH REDUCIN

CRIME.

HE WAS NOM GATED BY GEORGE W

BUSH TO HEAD THE DEPARTMENT OF

HOMELAND SECURITY, THAT CAME T

AN END WHILE CARRICK WAS BEING

VETTED, FACTS UNRAVELLED AND I

2010, HE WAS ARRESTED FO

PERJURY, AND TAX PROBLEMS, H

SPENT THE NEXT FEW YEARS BEHIN

PRISON WALLS AND NOW IS OUT AN

HAS BEEN THE AUTHOR OF A BOO

CALLED "FROM JAILER TO JAILED.

THANK YOU FOR SPENDING TIME WITH

US

I WANT TO TALK ABOUT THE CHANG

YOU EXPERIENCED.

BUT FIRST, SINCE WE HAVE YOU

HERE, LET ME GET YOU TO LEND

SOME OF YOUR EXPERTISE TO SOME

OF THE POLICING ISSUES THAT WE

SEE NOW ON THE STREETS HERE IN

NEW YORK CITY AND ELSEWHERE.

ONE OF THE REAL HOT BUTTON

ISSUES, ESPECIALLY IN NEW YORK

HAS BEEN THE NOTION OF STOP AN

FRISK.

WHERE DO YOU COME DOWN ON THAT

WHAT DO YOU THINK THE VALU

WOULD BE TO VISIT AT WHAT LEVEL?

>> FIRST OF ALL, PEOPLE HAVE T

REALIZE THE STOP AND FRISK WAS A

TOOL FOR THE POLICE DEPARTMENT

TO GO AFTER REALLY BAD GUYS.

YOU KNOW, COPS HAVE TRAINING

THEY HAVE INTUITION THEY HAVE

GUT INSTINCT

THEY ARE IN A HIGH CRIME AREA,

THEY SEE GUYS WALKING DOWN THE

BLOCK THAT LOOK SUSPICIOUS, THEY

ARE NOT ACTING RIGHT, THEY ARE

IN THE WRONG PLACE, YOU MAY WANT

TO CHECK THEM.

YOU MAY, YOU ARE LOOKING FOR

GUNS

YOU ARE LOOKING FOR BAD STUFF.

I WAS IN ANTI-CRIME IN A PLAIN

CLOTHES UNIT AND WE LOOKED FOR

GUNS, WE LOOKED FOR ROBBER

SUSPECT.

WE LOOKED FOR BAD GUYS

STOP AND FRISK GIVES YOU THE

ABILITY TO DO THAT

IT HAS TO BE MONITORED

CAN'T BE ABUSED.

YOU CAN'T RACIALLY PROFILE

BUT THERE'S A THING CALLED

CRIMINAL PROFILING

AND WHEN YOU ARE IN A BA

LOCATION

WHEN YOU ARE IN A HOT SPOT AREA,

WHEN YOU ARE IN A HIGH CRIME

AREA, YOU ARE LOOKING FOR BA

GUYS AND STOP AND FRISK GIVE

YOU THE ABILITY TO GO OUT AN

LOOK FOR BAD GUYS.

LOOK FOR GUNS, TAKE THE GUNS OFF

THE STREETS.

AND WHEN YOU ELIMINATE STOP AN

FRISK, DIMINISH IT, YOU WILL

TAKE LESS GUNS OFF THE STREETS

YOU WILL TAKE LESS HAD BAD GUY

OFF THE STREETS.

MORE GUNS MEANS MORE SHOOTINGS

AND MORE SHOOTINGS IS MORE

HOMICIDES AND WE HAVE SEEN

SPIKES IN NEW YORK CITY AS A

RESULT OF REDUCING O

DIMINISHING STOP AND FRISK

>> WHEN YOU WERE WORKING THE

STREET AND YOU SAID, YOU HAV

TRAINING AND INSTINCTS, WHAT

SORT OF SUCCESS DID YOU HAVE I

TAKING CRIMINALS AND GUNS OF

THE STREET

>> I HAD A LOT OF SUCCESS.

I WORKED IN MID TOWN

I HAD AN -- A FOOT POST ON WEST

42nd, BETWEEN 7th AND 8t

AVENUE

>> BUSY AREA

>> VERY BUSY

YOU RAN FROM ONE END OF TH

BLOCK TO THE OTHER

SOMEBODY GETTING MUGGED,

SOMEBODY GETTING ROBBED.

SOMEBODY JUMPING OFF THE

BUILDING

IT WAS AN INSANE ASYLUM OF A

POST FOR A COP

I HAD A LOT OF SUCCESS TAKIN

DID THE GU -- TAKING THE GUNS

OFF TH

STREETS.

BUT IT HAS A LOT TO DO WITH TH

COP THEMSELVES, HOW YOU APPROACH

PEOPLE

YOU GO UP TO SOMEBODY, YOU SEE

SOMEBODY DOING SOMETHING WRONG

OR SUSPICIOUS, YOU CAN HAVE

CONVERSATION WITH THEM, AND TAKE

IT DOWN A NOTCH.

OTHER THAN A PHYSICA

CONFRONTATION, OR, YOU KNOW, I

GETTING ABUSIVE.

OR CONSIDERED ABUSIVE.

I WROTE AN ARTICLE ABOUT THAT.

HOW ARROGANCE BY POLICE CAN BE

CONSIDERED RACISM.

IF I'M A WHITE COP AND I'M

ARROGANT OR OBNOXIOUS TO SOMEONE

OF COLOR

THEY THINK IT'S RACE

-- RACISM, IT'S NOT RACISM

IT'S JUST IGNORANCE.

THE COPS HAVE TO BE RESPECTFUL

AND RESPECT THE PUBLIC, BUT THEY

HAVE A JOB TO DO

IT'S AN IMPORTANT JOB AND IT'S A

DANGEROUS JOB AND THE MORE GUN

THAT COME OFF THE STREETS THIS

BETTER OFF WE ARE.

>> HOW ARE WE, BY WE, I MEAN THE

COMMUNITY.

HOW DO WE SORT OF, RECAPTURE OUR

RESPECT FOR THE POLICE OFFICER

ON THE STREETS

AND OUR WILLINGNESS TO

ACKNOWLEDGE THEY HAVE A VERY

DIFFICULT AND DANGEROUS JO

ESPECIALLY IN LIGHT OF SOME OF

THESE EPISODES THAT WE HAV

SEEN

IT'S A DIFFERENT WORLD NOW

EVERYTHING THAT HAPPENS ON THE

STREET GETS SHOWN.

WE HAVE SEEN THE EPISODES, FRO

VARIOUS PLACES, NOT JUST NEW

YORK CITY, WHERE POLICE SEEM T

BE USING EXTREME AND

EXTRAORDINARY AND UNNECESSAR

FORCE.

HOW COULD WE GET THE POLICE TO

RECAPTURE THAT RESPECT

>> JARKS HERE'S THE PROBLEM.

A LOT OF THE PERCEPTION OF THE

POLICE IS DRIVEN BY THE PRES

AND MEDIA.

EVERY DAY, I SEE DOZENS, IF NO

HUNDREDS OF POLICE INTERACTIONS,

ARRESTS, CONFRONTATIONS,

ASSAULTS, ALL THIS STUFF GOING

ON RELIGION GOOD STUFF

ON BEHALF OF THE COPS.

DO I EVER EVER SEE IT IN THE

MAINSTREAM MEDIA

>> NO.

YOU KNOW WHAT I SEE, WHE

THERE'S A NEGATIVE CONFRONTATION

BETWEEN THE POLICE AND PUBLIC.

THAT IS WHAT MAKES HEADLINES

I DON'T KNOW SEE ANY OF TH

OTHER STUFF.

PEOPLE SHOULD KEEP IT IN

CONTECH.

>> LET ME SHIFT THE FOCUS OF THE

CONVERSATION A BIT

I MENTIONED IN THE INTRODUCTIO

THE BOOK THAT YOU HAVE DONE.

AND IT'S A FASCINATING BOOK.

>> THANK YOU

>> AND I THINK WHEN PEOPLE REA

IT, AND THEY SHOULD READ IT,

THEY WILL SAY, HERE'S A GUY THAT

CAME FROM LITERALLY ON THE JOB

ON THE STREETS, COMMISSIONER O

THE DEPARTMENT OF CORRECTIONS,

YOUR FOCUS WAS WHERE WE AR

PUTTING PEOPLE

AND YOU CAME OUT OF THE TIME

THAT YOU SERVED IN PRISON AN

YOU ACCEPTED RESPONSIBILITY FO

YOUR MISTAKES, BUT YOU HAVE SEEM

TO COME OUT A VERY, VERY CHANGED

MAN.

WHY AND HOW?

>> WELL, FIRST, AND I WANT TO BE

CLEAR.

I PUT A LOT OF PEOPLE IN PRISON.

BAD GUYS THAT DID BAD THINGS

I BELIEVED IN LAW AND ORDER.

AND I BELIEVE PEOPLE HAVE TO B

HELD ACCOUNTABLE IF THEY COMMI

A CRIME.

WHAT I DID NOT REALIZE UNTIL I

GOT TO FEDERAL PRISON, WE AR

TAKING PEOPLE AND TURNING THEM

IN TO FELONS

FOR CIVIL VIOLATIONS, AND

COMMERCIAL FISHERMAN CATCHES TOO

MUCH FISH, WE LOCK HIM UP AND HE

IS CONVICTED OF A CRIME.

THEY TAKE THE REGULATORY

COMMISSION AND TURN IT IN TO A

CRIME.

HE COULD HAVE BEEN HEL

ACCOUNTABLE, TAKE HIS FISH

SUSPEND HIS LICENSE, FINE HIM,

DO SOMETHING

BUT DON'T TURN THESE PEOPLE IN

TO CONVICTED FELONS.

THE GUY SELLS A WHALE'S TOOTH ON

E BAY, YOU CONVICT HIM OF

CRIME.

THERE'S THOUSANDS OF THESE TYPES

OF CASES

AND THEN ON THE DRUG SIDE,

NOBODY IS A BIGGER, YOU KNOW

WAS A BIGGER DRUG EP FORCER THAN

I WAS.

I RAN ONE OF THE MOS

SUBSTANTIAL DRUG INVESTIGATION

IN NEW YORK WHEN I WAS ASSIGNE

TO THE DEA TASK FORCE, TONS OF

COCAINE, AND MILLIONS IN DRU

PROCEEDS

THEN I MET, 18, 19-YEAR-OL

KIDS

FIRST TIME, LOW LEVEL,

NONVIOLENT DRUG OFFENSES, TE

YEARS, 15 YEARS IN FEDERAL

PRISON AND THERE'S PEOPLE THAT

WILL WATCH THE INTERVIEW AND

SAY, THEY GOT WHAT THE

DESERVED

I DON'T THINK ANYBODY REALIZES

INCLUDING MOST IMPORTANTLY THE

PEOPLE THAT WRITE THE LAWS

YOU ARE TAKING FIRST TIM

NONVIOLENT OFFENDERS THAT COUL

HAVE BEEN DEALT WITH IN A DRUG

COURT OR GIVEN REHABILITATIO

FOR AN ADDICTION PROBLEM

YOU ARE TAKING THEM.

YOU ARE PUTTING THEM IN PRISON

YOU ARE GIVING THEM AN EDUCATION

THAT THEY ARE NEVER GOING TO GET

THEY WERE ELSE AND YOU ARE

TURNING THEM IN TO THUGS

IN TO MONSTERS

AND WHERE ARE THEY GOING

BACK IN TO YOUR COMMUNITY.

>> IN SOME WAYS THEI

INCARCERATION IS THEIR FINISHING

SCHOOL

>> YES, RIGHT, AND THEY AR

CONVICTED FELONS

SO, THEY ARE FORCED TO REVER

BACK TO CRIME.

AND NOW, YOU KNOW, THEY HAVE

LEARNED HOW TO STEAL, CHEAT,

LIGHT, MANIPULATE, CON, GAMBLE

AND MOST IMPORTANTLY IN PRISON

YOU LEARN THAT A VERBAL ALTE

INDICATION, MUST RESULT IN

SOMEBODY BEING BEAT DOWN O

STABBED.

IS THAT WHAT I WANT BACK IN MY

COMMUNITY?

I DON'T THINK SO

THERE'S PEOPLE, BAD GUYS THA

BELONG IN PRISON, PUT THEM

THERE.

AND LISTEN, SOME OF THEM PUT

THEM THERE FOR LIFE.

>> SOMEBODY MAY BE WATCHING AN

LISTENING TO YOU AND SAYING, YOU

KNOW, THAT MAKES A LOT OF SENSE.

MAYBE WE SHOULD HAVE REVIEW OU

APPROACH TO ALL OF THE CRIME

NOW, WHERE WE PUT PEOPLE AWA

FOR SIGNIFICANT TIME AND REVIE

OUR SENTENCING STRUCTURE

MY QUESTION TO YOU IS, THAT HA

TO BE DONE BY THE POLITICIAN

AND THE LEGISLATORS.

AND I'M WONDERING IN THIS DA

AND AGE, WOULD YOU GET POLITICAL

FIGURES THAT WOULD BE WILLING TO

PUT THEMSELVES OUT THERE KNOWING

THAT THEIR OPPONENTS WOULD SAY

SOFT ON CRIME IF THEY AR

WILLING TO TRY TO TAKE THI

APPROACH YOU ARE TALKING ABOUT

>> YOU KNOW, JACK, I HAVE BEEN

DOING IT FOR TWO YEARS NOW

SINCE I WAS RELEASED, CAME OUT

AND I HAVE BEEN PUSHING HARD I

WASHINGTON

AND I HAVE MET WITH ALMOST EVERY

MEMBER OF THE HOUSE AND SENATE

JUDICIARY, I HAVE MET WITH THE

MEMBERS OR THE SENIOR STAFF, AND

THERE'S A MAJOR BIPARTISAN

EFFORT, AND ACKNOWLEDGMENT THA

THERE'S ISSUES

MY CONCERN ABOUT GETTING IT DONE

IS NOT THEM UNDERSTANDING THAT

THERE'S A PROBLEM.

BECAUSE I CAN TELL YOU, 99% OF

THEM WILL SIT IN A ROOM WITH M

AND TELL ME, YOU ARE RIGHT

YOU ARE RIGHT.

THERE'S A PROBLEM.

WE HAVE TO STOP DOING THIS

WE HAVE TO CHANGE THE LAWS

BY CONCERN IS, THE POLITICAL

ELEMENT OF WASHINGTON.

WHO IS GOING TO DO WHAT, AND WHY

ARE THEY GOING TO DO IT?

IF THEY ARE GOING TO DO IT AND

YOU HAVE A CATEGORY OF PEOPL

THAT ARE SCARED TO DEATH TO LOOK

SOFT ON CRIME.

THIS IS NOT ABOUT BEING SOFT O

CRIME.

IT'S ABOUT BEING SMART ON CRIME.

WE ARE OVERLOADING PRISONS, WE

CAN HOLD PEOPLE ACCOUNTABL

WITHOUT PRISON

IN MANY, MANY CIRCUMSTANCES.

AND I THINK THIS IS SOMETHIN

THAT THE PRESIDENT WANTS

THE ATTORNEY GENERAL WANTS

ALL OF OUR CONGRESSMAN, MOST O

THE PEOPLE IN THE JUDICIARY ON

BOTH THE HOUSE AND SENATE, THE

ARE TALKING ABOUT IT

THERE'S A MAJOR EFFORT

THEY JUST GOT TO HAVE TH

COURAGE TO DO THE JOB THEY ARE

SUPPOSED TO DO

>> YOU KNOW, THERE'S SO MUCH

MORE TO TALK ABOUT

I HOPE WE CAN INVITE YOU BAC

AGAIN.
